This Privacy Policy applies to your use of www.jacksonwws-warranty.com (the “Website”) and contains Jackson WWS, Inc.’s (“Jackson,” “Owner,” “we” or “our”) policies regarding the collection, use and disclosure of your data and content when you use the Website.

By using this Website, you agree to the terms of this Privacy Policy and to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy may change over time. If any modifications substantially change your rights, we will provide notice on the Website, and you should check it regularly for any changes to our Privacy Policy. Use of the Website is acceptance of this Privacy Policy.

We gather various types of information, including information that identifies or may identify you as an individual (“Personal Information”), as explained in more detail below.

1. Personal Information You Give Us
We receive and store information, if any, that you voluntarily enter on our Website, such as names, e-mail addresses and other Personal Information. We do not sell your personal information. We may disclose your Personal Information to third parties or our affiliates in order to provide you with a requested service, such as registering for a warranty through our Website. We also may disclose or transfer your data or content in connection with the sale, merger, bankruptcy, sale of assets or re-organization of our company. In the event of such a transaction, the privacy policies and processes of another entity may control the use and disclosure of your information.
4. The Owner’s Policy for Children
The Owner does not wish to interact with or collect any data from users under the age of 13. We do not knowingly collect any Personal Information data from children under the age of 13. Minors should not use our Website without the consent of a parent or legal guardian unless legally permitted. If you are under the age of 13, please do not attempt to use the Website or send any personal information to us, including your name, address, telephone number, or e-mail address. 5. Cookies and Other Tracking Technology
As referenced above, we have some Website pages that may utilize cookies and other tracking technologies such as pixel tags and web beacons that enhance the functionality of our Website. Web beacons and pixel tags are embedded images in a webpage or e-mail for the purpose of gauging and analyzing usage and/or activity. The Website, or third-party service providers acting on our behalf, may use web beacons and pixel tags to help us analyze, use and improve our functionality. Some cookies and other technologies may serve to recall Personal Information provided by a user.

Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. For information about Do Not Track, visit www.allaboutdnt.org. At this time, the Website does not respond to Do Not Track browser settings or signals. Pixel tags, web beacons and other, similar technologies may be used by us and by third parties even if you have turned on the Do Not Track signal.

We comply with our own privacy practices and simultaneously adhere to accepted industry privacy standards considering the type of information maintained.

No data transmission over the internet or maintenance on any servers can be guaranteed as 100% secure; therefore, while we follow accepted industry standards and implement reasonable security practices to protect Personal Information, its security is not guaranteed.

10. Privacy Notice and Disclosures for California Residents
This Section 10 of the Policy applies solely to the personal data of users who reside in the State of California (“consumers” or “you”) and supplements the information contained in the rest of this Policy.

• RIGHTS PROVIDED BY CALIFORNIA CIVIL CODE SECTION 1798.83
A California resident who has provided personal data to a business with whom he/she has established a business relationship for personal, family, or household purposes (a “California Customer”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal data, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom personal data was disclosed in the preceding calendar year, as well as a list of the categories of personal data that were disclosed. California Customers may request further information about our compliance with this law by contacting Jackson by any of the methods identified in Section 9 above. Please note that we are only required to respond to two requests per California Customer each year under Code Section 1798.83.
• RIGHTS UNDER THE CALIFORNIA CONSUMER PRIVACY ACT
We have included the following provisions of this Policy to comply with the California Consumer Privacy Act of 2018 (“CCPA”), and any terms defined in the following portion of this Section 10. This section of our Privacy Policy provides California residents with a comprehensive description of Jackson’s online and offline practices regarding the collection, use, disclosure, and sale of personal information and the rights of California consumers regarding their personal information under the CCPA. This section applies to all California residents (but not including legal entities, such as companies). The section will not apply, however, if Jackson does not collect any Personal Information about you or if all of the information we collect is exempt from the statute (for example, the CCPA does not protect information that is already protected by certain other privacy laws, and it does not protect information that is already publicly available).
A. You Have A Right to Know About Personal Information Collected or Disclosed
California residents have the right to request that Jackson disclose what personal information it collects, uses and discloses. This is called the “Right to Know.” Under the Right to Know, you can request a listing of the types of personal information we have collected about you, the sources of that information, how we use the information (e.g., our business or commercial purposes for collecting personal information), other individuals and business with whom we share personal information, and the specific pieces of personal information that we have collected about you.

If you would like the above information, you may contact us through our webpage or customer service. Contact information is located in Section 9 above or you can make a request at 888-800-5672. When you make a request under your Right to Know, you can expect the following:

  1. We will verify your identity. You will need to provide us with certain personal information (e.g., an email address and certain personal information) to verify that you are who you say you are.
  2. We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.
  3. We will respond to your request within 45 days. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  4. In certain cases, a Request to Know may be denied, for example, if we cannot verify your identity or if providing you the information could create an unreasonable risk to someone’s security (for example, we do not want very sensitive information disclosed inappropriately). If we deny your request, we will explain why we denied it. If we deny a request, we will still try to provide you as much of the information as we can, but we will withhold the information subject to denial.

“Personal information,” for purposes of this section regarding the rights of California residents, does not include information that is lawfully made available to the general public from federal, state, or local government records.

B. You have a Right to Request Deletion of Personal Information about You
Because the Personal Information Jackson maintains is either deleted in a short period (e.g. cookies) or is exempt from deletion, such as warranty information, Jackson will not respond to a request to delete.
C. Sale of Personal Information
Jackson does not sell personal information of California consumers.
D. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights
You have a right not to receive discriminatory treatment by Jackson for exercising any of your privacy rights under the CCPA. Jackson will not discriminate against any California consumer because such person exercised any of the consumer’s rights under CCPA, including, but not limited to:

  • Denying goods or services.
  • Charging different prices or rates for goods and services, including through the use of discounts or other benefits or imposing penalties.
  • Providing a different level or quality of goods or services.
  • Suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services.

Jackson may, however, charge a different price or rate, or provide a different level or quality of goods or services, if that difference is related to the value provided to you by your data.

E. Authorized Agents
If you would like, you may designate an authorized agent to make a request under the CCPA on your behalf. We will deny requests from agents that do not submit proof of authorization from you. To verify that an authorized agent has authority to act for you, we may require a copy of a power of attorney or require that you provide the authorized agent with written permission and verify your own identity with us.
